Welcome to Wagzly. These Terms of Service govern your access to and use of Wagzly's website, software, onboarding tools, and related services. By using Wagzly, you agree to these terms.

2. Services

Wagzly provides software tools designed to support grooming businesses, including customer management, pet data tracking, appointment scheduling, messaging, and administrative workflows.

3. Eligibility and Account Responsibility

You must be legally able to enter into a binding agreement to use Wagzly. If you create an account or use the service on behalf of a business, you are responsible for maintaining account security, all activity under your account, and ensuring your use of the service complies with applicable laws.

4. Acceptable Use

You agree not to misuse the service. This includes not:

• violating applicable laws or regulations;
• attempting to gain unauthorized access to the platform;
• interfering with the security or performance of the service;
• uploading malicious code or harmful content; or
• using the service to send unlawful or unauthorized messages.

5. Customer Data

You may submit business, customer, pet, appointment, and communication-related data through Wagzly. You retain ownership of your data, and you grant Wagzly permission to process, store, and use that data as necessary to provide and improve the service.

You are responsible for the accuracy of the data you enter, your legal right to collect and use that data, and your compliance with privacy, data protection, and customer communication laws.

6. Messaging and Communications

If you use messaging features, you are responsible for obtaining any legally required consent from your customers before sending SMS, text messages, reminders, or similar communications.

Message delivery depends on third-party providers, carrier networks, customer devices, and customer settings. Wagzly does not guarantee message delivery, timing, or availability.

7. Payments and Subscription Terms

Certain features may require payment or a subscription. Pricing, billing terms, renewals, and feature access may be described separately within the product or on a pricing page.

Failure to pay may result in suspension or termination of access. Unless otherwise stated, payments are non-refundable.

8. Availability

We aim to keep Wagzly available and reliable, but we do not guarantee uninterrupted or error-free service. Maintenance, outages, third-party failures, or other issues may affect availability.

9. Third-Party Services

Wagzly may rely on third-party providers for hosting, infrastructure, messaging, payments, analytics, and other service functions. We are not responsible for failures, delays, outages, or actions of third-party services.

10. Intellectual Property

Wagzly and its related branding, software, designs, content, and materials are owned by Wagzly or its licensors and are protected by applicable intellectual property laws. Except as allowed by law, you may not copy, modify, distribute, or reverse engineer the service.

11. Disclaimer

Wagzly is provided on an “as is” and “as available” basis. Except to the extent prohibited by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, Wagzly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business interruption arising from or related to your use of the service.

You agree to defend, indemnify, and hold harmless Wagzly from any claims, damages, losses, liabilities, or expenses arising from your use of the service, your customer data, your messaging practices, or your violation of these terms or applicable laws.

We may suspend or terminate access to the service if these terms are violated or if continued access creates legal, technical, or security risk. You may stop using the service at any time.

These terms are governed by the laws of the State of California, without regard to conflict of law principles.
